The demand for highly skilled workers for U.S. employers is ever-present and achieving continual success in meeting that demand can be ever-challenging.

The traditional method of using the H-1B visa for specialty occupation workers is still available and useful, although its effectiveness in meeting the needs of employers may be limited by the annual quota for H-1B visas and the limits to the H-1B extension.

Fortunately, U.S. immigration laws allow additional methods by which U.S. employers can satisfy their workforce requirements. These options include the PERM process and the L-1 visa (intra-company transfers).

These options can present great opportunity, for employer and employee alike, but to be able to benefit from this opportunity, it is crucial that the statutory and regulatory requirements of each of these processes be met.
